PARALLEL IMPORTED TOYO TIRES

Notice to Retailers and Customers

Toyo Tyre & Rubber Australia Limited (“Toyo Australia”) is the only accredited and authorised importer and
distributor of ‘Toyo’ branded products for passenger, light truck, truck and bus, industrial and earthmoving

vehicles for the Australian market.

Any other businesses or persons involved in the importation, promotion and selling of Toyo Tires branded
product(s) are not authorised agents of Toyo Australia and/or Toyo Tire & Rubber Co. Limited of Japan (the

“Manufacturer”).

The cause
“Parallel importing” is the importation of goods through channels other than those authorised and supported
by the brand stewards of the goods in question. It affects most industries in free enterprise markets around
the world and varies in its extent relative to the prevailing market and economic conditions in the various

global trading markets.

The tyre industry in Australia is currently being affected due to certain production overcapacities and the

strength of the Australian dollar.

The implication
The result for the consumer is often a cheaper alternative; but invariably at the possible expense of after sales
support; technical support; marketing assistance; supply continuity; and market suitability of the product.
Tyres imported and sold through Toyo Tyre & Rubber Australia Limited are extensively scrutinised under the
company’s Quality Assurance Program (ask Toyo Australia about “QAP”) ensuring the best possible product

for the local market conditions.

Although carrying the same trademark, parallel imported tyres are not tested under Toyo Australia’s QAP for

Australian road conditions and therefore may not meet Toyo Australia’s standards.

Toyo Tyre & Rubber Australia Limited cannot on behalf of the manufacturer, Toyo Tire & Rubber Co., Limited
of Japan, warrant any “Toyo Tires” brand product that has not been distributed by Toyo Tyre & Rubber

Australia Limited.
